The First Amendment: Police Force And First Amendment Trespasses In The Ferguson Protests The killing of Michael Brown by a police officer in Ferguson, Missouri on August 18, 2014 has led to police protests by the citizens of Ferguson. In the wake of these protests, the Ferguson police have been violating the First Amendment rights of these protesters and reporters covering this story. Specifically, police have arrested and jailed reporters and television crews and have banned nighttime protests. Ferguson Police are also trying to suppress coverage of the protests by restricting where the media can report from. According to Gregory P. Magarian, a law professor at Washington University Law School, “Since Sunday’s police shooting of an unarmed student, Michael Brown, local officials and law enforcement have blatantly violated three core First Amendment principles: our right to engage in peaceful political protest, the importance of open government; and the freedom of the press.” The First Amendment states, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” Because of this, the Ferguson police have no right to prevent the freedom of speech/press and the freedom to assemble.
