O'Donnell was aware of his brother's symptoms immediately and prompted him to go back to the doctor's office to check if his condition was anything more serious than the flu. O'Donnell guarantees that Dr. Kerr misdiagnosed his brother and for this reason compensation should be given to O'Donnell for Kerr's negligence. Jacobs went to Kerr's office the day after he returned home and Kerr failed to ask Jacobs if he traveled recently which could have given Jacobs the possibility of having a blood test.
