The Fourth Amendment: Smartphones and the 4th Amendment In April 2014 there were two separate cases that involved the police seizing phones. In Boston the police arrested a man on drug charges and seized a man’s flip phone. One the phone they saw and incoming call that led them right to an apartment where they found drugs, money, and guns. In San Diego police seized a mans smartphone at a traffic stop. They saw suspicious texts that connected the owner of the phone to gangs. They later a detective searched the phone looking for evidence. They found photos and videos that involved the owner of the phone in gang related crimes. The Supreme Court will consider whether law enforcement officers during an arrest may search the contents of a person’s mobile phone without a warrant. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
