Union Victories Student Athletes In 1984 the Supreme Court stripped the NCAA of its TV rights, making it possible for the conferences to sell their games directly to television and radio. The NCAA then used an obscure sentence in the ruling to prevent student athletes from receiving compensation. It reads “In order to preserve the character and quality of the NCAA’s product (the athletes), athletes must not be paid, must be required to attend class and the like. ” Should athletes be compensated for the work they do as NCAA athletes. US District Judge Claudia Wilkens thinks so and ruled that the NCAA ’s restrictions prohibiting payment for the use of their image, names and likenesses was a violation of the anti-trust law. Her ruling paves the way for football and basketball players to receive scholarships covering their full attendance and deferred payments for the use of their names, images and likenesses. How will this ruling impact student athlete’s unionization nationally remains to be seen. Stay tuned. AMERICAN AIRLLINE PASSENGER SERVICE AGENTS On September 16, after years and many close votes, American Airlines passenger service agents voted to unionize by 86%. This win represents victory for over 14,500 passenger service agents. These are the people who handle your reservations, your luggage and staff the departure gates just before you board your plane. In 2013, American spent nearly $4 million dollars trying to bust the union. However, for this vote they were largely uninvolved. Threats of outsourcing were always on the minds of these workers. Many of the jobs previously held by these agents have been taken over by self-serve check in modules and many of the agents wondered what would be taken over next. The e-magazine LaborNotes.org reported that Eula Smith, a customer service agent in Charlotte, North Carolina stated that she “ felt stronger with this vote. I’m a 60 -year- old woman with 42 years with this employer. You can’t live in the South and make a decent wage unless you are in senior management in a corporation or belong to a union.” The employees wanted union representation to badly that without formally being recognized by a union, 400 of these men and women paid dues, got training for steward to represent workers during disciplinary hearings. Retirees even got involved to see this vote have a successful outcome. Congratulations!
